Exporting — that is, the shipment or transmission of items or material outside of a country — is heavily regulated by federal laws and regulations referred to collectively as "export controls." These controls affect the export of commodities (goods and materials), technology (technical data and know-how) and software from the domestic country to a foreign country. They also affect the re-export of any such items from one foreign country to another, as well as products made outside the country by or for a domestic company. In recent years, the government has increased penalties for export control law violations. A person who intentionally violates export regulations may incur fines up to $1,000,000 and imprisonment for up to 20 years. In addition, a company may be fined up to $1,000,000, or five times the value of the exports for each violation (whichever is greater), and its export privileges may be suspended or revoked. This course provides an overview of US export controls. It details the most common of "red flags" — situations presenting a risk of export-control violations — that employees of organizations that export items should learn to recognize and respond to appropriately. |
